The Mobile Banking Agreement and Disclosure Statement states the terms and conditions that you agree to, by using our Cell Phone Banking service. This agreement supplements the AHB deposit Account Agreement and Disclosures and any other agreement between you and AHB. In the event of any conflict with any other agreement regarding Mobile Banking, this agreement will control.

The terms “you” and “your” refer to any person that is authorized to access account information, by using the Cell Phone Banking Username and Password provided to the applicant. The terms “We”, “us”, “our”, “AHB”, and “Bank” refer to American Heritage Bank. The terms “Mobile Banking” and “Cell Phone Banking” are used interchangeably and refer to our service that allows you to access your AHB accounts and perform transactions via your cell phone with web browsing/internet capabilities.

Please read this entire Agreement prior to using AHB’s Cell Phone Banking Service. By using Cell Phone Banking, you acknowledge your receipt and understanding of this disclosure and agree to all terms and conditions of this agreement.

Account Eligibility

Cell Phone Banking is available to any personal account holder. Eligibility for commercial accounts will be determined by the accounts officer.

Available Services

With Mobile Banking you can instantly access your Checking, Savings, and Loan accounts, and;

  1. Check your balances and current account transactions.
  2. Review transaction history since your last statement.
  3. Transfer funds between your AHB accounts with like ownership.

User ID, Password, and Security Question

To access Cell Phone Banking you must use the username, the six digit password provided by the bank, and the answer to the security question that you provided during the application process. Your username and temporary password will be contained in your welcome letter. It will be your responsibility to remember the answer to your security question. The first time you access the Cell Phone Banking service, you will enter the default password from your welcome letter, which will usually consist of six random letters and/or number. You will then be prompted to change your assigned password to a new password, of your choice. For added security, it is required that your new password is alphanumeric (containing both numbers and letters).

You are responsible for keeping your username, password, and security answer private. Anyone to whom you give your username, password, and security answer will have access to your accounts. You are liable for all transactions that you or anyone to whom you reveal your username and/or password performs. If you think that your username, password, or security answer have been lost or stolen, immediately notify our customer service department at (918) 224-3210.

Limits on Cell Phone Banking Transactions

Transactions conducted via Mobile Banking are subject to all withdrawal and transfer limitations and excess activity charges described in the AHB Deposit Account Agreements and Disclosures.

Limitations on Frequency of Transfers

Transfers from a money market deposit account to another account or to third parties by preauthorized, automatic, American Net, Cell Phone banking, or telephone transfers are limited to six per month or statement cycle with no more than three by check, debit card, or similar order to third parties.

Preauthorized transfers from a savings deposit account, through an automated clearing house (ACH) or otherwise, American Net transfers, telephone transfers, cell phone banking, and wire transfers are limited to six per month.

Hours of Accessibility

In general, Cell Phone Banking is accessible 24-hours per day, seven days a week; however, AHB does not guarantee that Cell Phone Banking will be available at all times. Occasionally, due to system maintenance or reasons beyond our control, the mobile banking service may be unavailable.

Transactions are processed on business days only. Every day is a business day except Saturdays, Sundays, and Federal Holidays. A transfer initiated before 6:00 p.m. CST on a business day is posted to your account the same day. A transfer completed after 6:00 p.m. CST on a business day or on a non-banking day, as specified above, will be posted on the next business day.

Termination of Account Access

Either you or we may terminate this agreement and mobile banking service at any time upon giving the other party at least 10 business days written notice of termination. If you terminate your mobile banking service, we reserve the right to continue making previously authorized transfers, and other transactions until we have a reasonable opportunity to act upon your termination notice. Once your Cell Phone Banking service is terminated we will make no further transfers, or other transactions you have previously authorized.

Equipment and Software

American Heritage Bank does not guarantee that your cell phone/cell phone service plan will be compatible with our Cell Phone Banking service. You are responsible for the operation and maintenance of your cell phone. AHB is not responsible for any errors or problems related to your cell phone, cell phone provider, or mobile internet access. Nor are we responsible for any fees assessed by your telephone company, internet service provider, or any other outside party.

Cell phones with internet capabilities are susceptible to viruses. Customers are responsible for making sure that the cell phone they are using to access Mobile Banking is protected from and free of viruses, worms, Trojan horses, or other similar harmful components (collectively, referred to as "viruses"), which could result in damage to programs, files, and/or your phone or could result in information being intercepted by a third party. AHB will not be responsible or liable for any indirect, incidental, special or consequential damages that may result from such harmful components being present on the cell phone, nor will AHB be responsible or liable if sensitive information accessed via our Mobile Banking service is intercepted by a third party due to any of the above named “viruses” residing or being contracted by the customer’s cell phone at any point or from any source.

Electronic Mail (email)

You may choose to communicate with AHB using electronic mail. However, be advised that email transmissions are not secure. We strongly discourage you from sending confidential account information to AHB via email. AHB is not responsible for any error or problems of any kind involving your email. At no time will any AHB employee ask for confidential information over email.

New Services

AHB may, periodically, introduce new Mobile Banking services. We will notify you of any new services. By using the new services when they become available, you agree to be bound by the terms and conditions concerning these services.
