AMERICAN HERITAGE BANK INTERNET SERVICES

INTRODUCTION

This American Heritage Bank Internet Services Agreement and Disclosure Statement explains the terms and conditions that apply when you use any of our Internet Services.  This Agreement supplements the AHB Deposit Account Agreement and Disclosures and any other agreement between you and AHB.  This agreement applies to both consumer and commercial customers unless specified otherwise. In the event of any conflict with any other agreement regarding AHB Internet Services, this agreement will control.

 

The terms "you" and "your" refer to each person who is authorized to use an Internet Banking User Identification Number (ID) and Personal Identification Number (PIN).  "We", "us", "our" "AHB" and "Bank" refer to American Heritage Bank. The term "Internet Services" refers to any combination of our four online services accessed over the Internet using a personal computer and modem, cell phone, or personal data device. "Internet Banking" and "Online Banking" are used interchangeably to refer to the service that allows you to access your AHB accounts and perform transactions. "Bill Pay" refers to our online bill payment service. "E-statements" refers to our service that allows you to be notified by email and "pull" your periodic statements from a secure site, rather than receiving them in print.  "Cell Phone Banking" refers to our mobile version of Internet Banking.

 

Please read this entire Agreement prior to using AHB's Internet Services.  By using any of AHB's Internet Services, you acknowledge your receipt and understanding of this disclosure and agree to all terms and conditions of this Agreement.

 

AHB Internet Banking

 

Account Eligibility

     Internet Banking is available to any account holder.

 

Available Services

With AHB Internet Banking you can instantly access your Checking, Savings, CD, IRA, and Loan accounts, and; 

  • 1. Check your balances and current account transactions. 
  • 2. Review transaction history since your last statement. 
  • 3. View check images.  
  • 4. Transfer funds between your AHB accounts. 
  • 5. Print your history information. 
  • 6. Download account information into compatible money management software. 
  • 7. Submit a loan inquiry online to start the loan process. 
  • 8. Submit information to begin the process of opening a deposit account.

 

User ID and PIN

Each time you access Internet Banking you must use the User Identification Number (ID) provided by the bank or an alias you have entered and an alphanumeric PIN. The first time you access Internet Banking, you will enter your default PIN. Then you must change your assigned PIN to a new alphanumeric PIN of your choice.

 You are responsible for keeping your User ID and PIN private.  Anyone to whom you give your User ID and/or  PIN will have access to your accounts.  You are liable for all transactions performed by you or anyone to whom you reveal your User ID and/or PIN.  If you think your User ID and PIN have been lost or stolen, immediately notify our customer service department at (918) 224-3210.

 

Limits on Internet Banking Transactions

     Transactions conducted via internet banking are subject to all withdrawal and transfer limitations and excess activity charges described in the AHB Deposit Account Agreements and Disclosures.

 

Limitations on Frequency of Transfers

     Transfers from a money market deposit account to another account or to third parties by preauthorized, automatic, Internet Banking or telephone transfers are limited to six per month or statement cycle with no more than three by check, debit card, or similar order to third parties.

      Preauthorized transfers from a savings deposit account, through an automated clearing house (ACH) or otherwise, Internet Banking transfers, telephone transfers, and wire transfers are limited to six per month.

 

Stop Payments

     A stop payment order must be given in the manner required by law and must be received in time to give us a reasonable opportunity to act on it before our stop-payment cut-off time.  Our stop-payment cut-off time is one hour after the opening of the next banking day after the banking day on which we receive the item.  Additional limitations on our obligation to stop payment are provided by law.  A stop-payment order must precisely identify the number, date and amount of the item, and the payee.  Other rules apply.

 

Hours of Accessibility

     In general, AHB Internet Banking is accessible 24-hours per day, seven days a week; however, AHB does not guarantee that Internet Banking will be available at all times.  Occasionally, due to system maintenance or reasons beyond our control, Internet Banking may be unavailable.

      Transactions are processed on business days only.  Every day is a business day except Saturdays, Sundays, and Federal Holidays.  A transfer initiated before 6:00 p.m. CST on a business day is posted to your account the same day.  A transfer completed after 6:00 p.m. CST on a business day or on a non-banking day, as specified above, will be posted on the next business day.

 

Bill Pay 

General Rules

     AHB Internet Banking includes an optional bill payment service (Bill Pay) through which you may arrange for payment of bills from the checking account you designate.  AHB has contracted with an outside vendor to provide bill payment services.  AHB is not liable for any losses or errors associated with the bill payment service.

      You may use the bill payment system to pay an individual or merchant approved by the bill payment service provider.  By furnishing the names and addresses of your payees, you authorize the bill payment service provider to follow the payment instructions provided by you. 

       Upon receipt of your payment instructions, the bill payment service provider will debit your selected checking account for payments that qualify to be electronic and remit payment to the specified payee(s). Check payments will be mailed the same day they are processed and will be debited from your account when the check clears.

      You should allow up to four (4) business days for the payment to reach the payee if the payment is made electronically and up to ten (10) business days to reach the payee if the payment is made by check.

     AHB is not responsible for any fees or penalties charged to you, by any payee, as a result of a late payment.

Account Eligibility

      Consumer Customers

     To be eligible for Bill Pay you must have an active personal checking account with American Heritage Bank.  Bill payment services are not available to non-personal account holders. Excessive insufficient activity could result in bill payment services being revoked.

 

     Commercial Customers (Corporation, Partnership, LLC, Political Subdivision)

     Bank officer approval is required for commercial account holders to be eligible for Bill Pay. Corporate accounts must have minutes from the board approving service as well as a signed Commercial Internet Banking Bill Payment Authorization Resolution. Excessive insufficient activity could result in bill payment services being revoked. 

 

Bill Pay Limitations

     Transactions are limited only by the available funds in your designated account. There is no cap on the amount of any single bill payment nor is there a limit to the total number or total dollar amount of bill payments allowed daily.  Bill Payment transactions are subject to all regulatory and AHB limitations.  Payments delivered over an automated clearinghouse system (ACH) are governed by the rules and performance standards of the Automated Clearing House (ACH).

    

Bill Payment Liability

     Neither the Bank, nor the bill payment service provider is liable for:    

  • 1. A failure to perform or a loss resulting from an event or condition beyond the reasonable control of either AHB or the Bill Payment service provider, including but not limited to communications breakdown or interruption, acts of God, labor disputes or interruption of service by ACH or other payment networks. 
  • 2. Punitive, exemplary, consequential, indirect, remote, or special damages. 
  • 3. The loss of confidentiality or security of data or other payment information while in transmission over communication lines, in the postal system, or in an ACH or other network.

 

NSF and Returned Bill Payment Items

Electronic payments are verified for funds availability during processing.  If the funds are not available at processing you will receive a message informing you that the payment could not be processed due to insufficient funds.  The payment will continue to attempt until sufficient funds are available or until you delete the payment.  Please make sure your account has sufficient funds at the time electronic items are to be processed so not to delay your payment reaching the vendor.  Check payments are subject to the account balance when they are presented for payment. AHB reserves the right to return check payments presented against insufficient funds and to assess overdraft fees and returned item fees in accordance with AHB fee schedule.

 

Our Liability for Failure to Complete Transfers or Payments

     We will take reasonable care to complete funds transfers and payments according to your instructions.  Examples of situations in which AHB is not responsible for completing payments or transfers include, but are not limited to, the following: 

  • 1. If you do not have enough available money in an account from which a payment or transfer is to be made. 
  • 2. If your account is closed or is not in good standing. 
  • 3. If legal order directs us to prohibit withdrawals from your account. 
  • 4. If you or anyone you authorize commits any fraud or violates any regulation. 
  • 5. If your equipment, or our equipment, was not working properly and the breakdown should have been apparent to you when you attempted the transaction. 
  • 6. If you have not provided the information necessary to complete the transaction. 
  • 7. If you have provided us with inaccurate information or fail to correct inaccuracies of which you are aware. 
  • 8. If you did not properly follow instructions for using Internet Banking. 
  • 9. If you did not allow ample time for your payment to be received and credited. 
  • 10. If, despite our precautions, circumstance beyond our control prevent, delay, or alter the transaction.

 

Fee Schedule

     Bill Pay is

  • $3.00 per month for the first 10 transactions; $0.40 for each transaction thereafter

 

Additional fees related to Bill Pay services:

Stop payments                 $25.00 per item

Copy of bill pay check     $2.50 per copy

Paid Overdraft fee            $25.00 per item

Return item fee                $25.00 per item

 

The bank's paid/returned overdraft fee includes transactions such as: checks, in person withdrawals, ATM withdrawals, or other electronic or paper items.

 

Payment Account

     When you sign up for AHB Internet Banking, you must designate which checking accounts you would like Bill Pay capability added to. In doing so, you authorize AHB to debit your payment account for charges including, but not limited to, bill payments, inactivity fees, overdraft fees, and stop payment fees.  Bill Pay inactivity fees will be debited from the checking account that has become inactive. Internet Banking fees are in addition to any other service charges assessed by AHB.  Please refer to the Fee Schedule for a complete description of service charges and fees.

      If you close your payment account, you must notify customer service and designate a new payment account.  If you close all your bank accounts, you must notify AHB customer service department and cancel your Bill Pay services.

 

 

E-statements

 By signing the E-statement application, you authorize American Heritage Bank to send notice of regular periodic account statement(s) to the email address you provided, in lieu of sending a paper copy. You will then be provided with a secure website, E-statement user name and password which will enable you to view, print, or download your periodic statement(s) for a minimum of 90 days from the day they are dated. You also agree to promptly review E-statement and notify AHB of any errors within 60 days of the date of the statement containing the error.

 You further agree to receive periodic account notice and disclosure information in an electronic format.  AHB will provide this information in a clear manner that can be printed and/or stored.  At any time you have a right to obtain a paper copy of any of the above-described E-Notice /Disclosures or E- Statements.  To obtain a paper copy, you must make a specific request to AHB either in person, by phone, or by mail. Research fees specified in the bank's schedule of fees may apply.

 You agree to notify the Bank immediately if you are unable to access any of the information that has been delivered by AHB in an electronic form or manner. Furthermore, you agree to provide the Bank with signed, written notice if your e-mail address changes.

 

Cell Phone Banking

 Cell Phone Banking is a service that allows you to access your AHB accounts and perform transactions via your cell phone with web browsing/internet capabilities.  Cell Phone Banking utilizes the same security and Bill Pay features as our Internet Banking service.

 

Account Eligibility

Cell Phone Banking is available to any personal account holder that is eligible to use our Internet Banking service. 

 

Available Services

With Cell Phone Banking you can instantly access any account that has been set up for Internet Banking use.

  • 1. Check your balances and current account transactions.
  • 2. Review transaction history since your last statement.
  • 3. Transfer funds between your AHB accounts.
  • 4. View branch location information and maps.
  • 5. Pay bills on the go using our Bill Pay service.(optional)

 

User ID and PIN

To access Cell Phone Banking, you must have a valid Internet Banking User Identification Number and alphanumeric PIN.  If you are not currently set up for Internet Banking, you may fill out an application at any of our locations or at www.ahb-ok.com.

 You are responsible for keeping your User ID and PIN private.  Anyone to whom you give your User ID and/or PIN will have access to your accounts.  You are liable for all transactions performed by you or anyone to whom you reveal your User ID and/or PIN.  If you think your User ID and PIN have been lost or stolen, immediately notify our customer service department at (918) 224-3210.

Equipment and Software

American Heritage Bank does not guarantee that your cell phone/cell phone service plan will be compatible with our Cell Phone Banking service.  You are responsible for the operation and maintenance of your cell phone.  AHB is not responsible for any errors or problems related to your cell phone, cell phone provider, or mobile internet access.  Nor are we responsible for any fees assessed by your telephone company, internet service provider, or any other outside party.

 Cell phones with internet capabilities are susceptible to viruses. Customers are responsible for making sure that the cell phone they are using to access Cell Phone Banking is protected from and free of viruses, worms, Trojan horses, or other similar harmful components (collectively, referred to as "viruses"), which could result in damage to programs, files, and/or your phone or could result in information being intercepted by a third party. AHB will not be responsible or liable for any indirect, incidental, special or consequential damages that may result from such harmful components being present on the cell phone, nor will AHB be responsible or liable if sensitive information accessed via our Cell Phone Banking service is intercepted by a third party due to any of the above named "viruses" residing or being contracted by the customer's cell phone at any point or from any source.

 

 Other Information pertaining to Internet Services

 

Documentation of Transfers and Bill Payments

     AHB will not provide separate receipt or documentation for bill payments and transfers conducted via Internet Banking.  Your Internet Banking transfers and bill payments will appear on your account statement.  You agree to notify us promptly if you change your address.

 

Questions or Error Corrections on AHB Internet Banking Transactions

     Call or write AHB as soon as possible if you think your statement or receipt is wrong or if you need more information about a transfer or bill payment listed on a statement or receipt.  We must hear from you no later than 60 days after we send you the FIRST statement on which the problem or error appeared.

 If you tell us verbally, we may require that you send your complaint or question in writing within 10 business days.

 

Unauthorized Transactions

 

Consumer Customers

Notify us immediately if you believe that someone has obtained your User ID and PIN or if you believe that someone has conducted unauthorized or fraudulent transactions on your account.

 If your User ID and PIN have been compromised and you tell us within two business days after you learn of the loss or theft, you can lose no more than $50 if someone used your User ID or PIN without your permission to access a deposit account.  If you do not tell us within two business days after you learn of this loss or theft, and we could have stopped someone from taking money without your permission had you told us, you could lose as much as $500.

 Also, if your statement shows withdrawals, transfers, or purchases that you did not make or authorize, please notify us at once.  If you do not notify us within 60 days after the statement was sent to you, and we could have stopped someone from taking money if you had told us in time, you may not get any money after 60 days.  If extenuating circumstances, such as a long trip or hospital stay, kept you from telling us, the time periods in this section will be extended.

 

 

Commercial Customers

Notify us immediately if you believe that someone has obtained your User ID and PIN or if you believe that someone has conducted unauthorized or fraudulent transactions on your account. Also, please notify us at once if your statement shows withdrawals, transfers, or purchases that you did not make or authorize. The Commercial Internet Banking Bill Payment Authorization Resolution signed by authorized agent(s) of your organization does save, hold harmless, and indemnify Bank for any damages to the organization caused by any negligent act or omission, misuse or unauthorized use of this product and none of the provisions set forth for consumer customer above apply.

 

Termination of Account Access

Either you or we may terminate this Agreement and any of the Internet Services at any time upon giving the other party at least 10 business days written notice of termination.  If you terminate your AHB Internet Service, we reserve the right to continue making previously authorized transfers, bill payments, and other transactions until we have a reasonable opportunity to act upon your termination notice.  Once any of your Internet Services are terminated we will make no further transfers, bill payments, or other transactions you have previously authorized.

 

Equipment and Software

You are responsible for the operation and maintenance of your computer and software.  AHB is not responsible for any errors or problems related to your computer hardware, software, or Internet access, for fees assessed by your telephone company, Internet service provider, or any other outside party.

 Customers are responsible for making sure the computer they are using to access AHB Internet Services is protected from and free of spyware and viruses, worms, Trojan horses, or other similar harmful components (collectively, referred to as "viruses"), which could result in damage to programs, files, and/or hardware or could result in information being intercepted by a third party. AHB will not be responsible or liable for any indirect, incidental, special or consequential damages that may result from such harmful components being present on the computer nor will AHB be responsible or liable if sensitive information accessed via AHB Internet Banking, or the E-statement site or link is intercepted by a third party due to any of the above named "viruses" residing or being contracted by the customers computer at any point or from any source.

Notice: Effective April 8, 2010, Internet Explorer version 6.0 will no longer be a valid browser for accessing Internet Banking. Microsoft no longer supports versions earlier than 7.0 and security updates are not available. To ensure you have a valid, secure browser for accessing Internet Banking, it is recommended to download Internet Explorer 7.0 or higher. Note: Since IE 7.0 is not compatible with Microsoft Windows 2000 operating system, it is advised to download Firefox 3 or higher.  For more information, click here to view the list of all supported browsers.   

   

Electronic Mail (email)

You may choose to communicate with AHB using electronic mail.  However, be advised that email transmissions are not secure.  We strongly discourage you from sending confidential account information to AHB via email.  AHB is not responsible for any error or problems of any kind involving your email.  At no time will any AHB employee ask for confidential information over email.

 

New Services

AHB may, periodically, introduce new Internet services.  We will notify you of any new services.  By using the new services when they become available, you agree to be bound by the terms and conditions concerning these services.
